Under Prime Ministerial Decision No.33/2026/QD-TTg, recently signed by Deputy Prime Minister Ho Quoc Dung, a list of high-risk artificial intelligence (AI) systems in education, ethnic and religious, healthcare, banking, transport, and judicial sectors has been promulgated.
A high-risk AI system is the system that may cause significant damage to life, health, rights and legitimate interests of organizations, individuals, national interests, public interests, and national security, the Government News explained.
In the field of education, high-risk AI systems include systems designed to provide self-study content based on educational curricula that utilize uncontrolled data sources; AI-integrated systems that automatically test, evaluate, and rank learners; and AI-integrated systems used to monitor and analyze learner behavior.
In ethnic and religious sector, high-risk AI systems include systems that automatically score, classify, and rank profiles to determine beneficiaries and regions eligible for ethnic policies; AI-integrated systems that automatically verify and decide on the validity of information regarding ethnicity and religion; and AI-integrated systems that automatically decide to approve or reject registration applications, or to renew or revoke state management decisions in the ethnic and religious sector.
In healthcare sector, high-risk AI systems include systems used to assist surgery and surgical robots; AI-assisted systems (machinery, equipment, robotic system automatically controlled using AI)
In banking sector, high-risk AI systems include systems that automatically perform e-transactions in banking activities; AI-powered systems that automatically make credit granting decisions.
In judicial sector, high-risk AI systems include large-scale biometric identification systems used for resolving public civil cases.
In the field of transport, high-risk AI systems comprise of 31 systems such as: High-level autonomous driving AI systems in transport vehicles; AI systems that control or automatically operate road and railway traffic signals; AI systems that manage and control the operation of transport infrastructure and critical technical infrastructure.
According to the AI Law adopted by the National Assembly in 2025, high-risk AI systems must undergo a conformity assessment before being put into service or whenever significant changes occur during its use.
